Death penalty: Council of Europe calls on USA to stop and think

Strasbourg, 25.06.2002 - Council of Europe Secretary General Walter Schwimmer today reacted to the recent ruling by the United States Supreme Court which overturns more than 150 judge-imposed death sentences.

Walter Schwimmer was commenting on this ruling which holds that it is unconstitutional for a sentencing judge, sitting without a jury, to find an aggravating circumstance necessary for the imposition of the death penalty. He underlined the significance of this decision by the Supreme Court, which is the second within a week, to restrict the use of the death penalty in the United States. "These decisions expose only some of the fundamental problems linked to capital punishment and I call upon the US authorities to use this opportunity to review thoroughly the use of the death penalty in general and pending this review to institute a moratorium on executions", the Secretary General said.

Walter Schwimmer also recalled the recent statement by the Committee of Ministers of the Council of Europe, expressing its readiness to enter into a dialogue with Observer States such as the United States on the institution of moratoria on executions with a view to the abolition of the death penalty. The Council of Europe considers that this penalty is contrary to human rights and that it has no place in civilised society.

Peine de mort: le Conseil de l'Europe invite les Etats Unis à la réflexion Strasbourg, 25.06.2002 - Le Secrétaire Général du Conseil de l'Europe Walter Schwimmer a réagi aujourd'hui à la récente décision de la Cour Suprême des Etats Unis qui a pour conséquence la révision d'au moins 150 condamnations à mort.

Commentant cet arrêt déclarant inconstitutionnelle la possibilité pour un juge non assisté d'un jury de trouver des circonstances aggravantes menant à une condamnation à mort, Walter Schwimmer a souligné qu'il était significatif qu'en l'espace d'une semaine la Cour Suprême ait rendu deux arrêts restreignant le recours à la peine de mort aux Etats Unis. " Ces arrêts ne reflètent que certains des problèmes fondamentaux posés par la peine de mort. J'invite les autorités américaines à saisir cette occasion pour revoir attentivement la question générale du recours à la peine capitale, et pour instaurer entre-temps un moratoire aux exécutions " a notamment déclaré le Secrétaire Général.

Walter Schwimmer a également rappelé la récente déclaration du Comité des Ministres du Conseil de l'Europe indiquant qu'il était disposé à entamer un dialogue avec les Etats observateurs auprès de l'Organisation, comme les Etats Unis, pour l'instauration d'un moratoire aux exécutions en vue de l'abolition de cette peine. Le Conseil de l'Europe considère que la peine de mort est contraire aux droits de l'homme et qu'elle n'a pas sa place dans une société civilisée.
