CREATING A UNANIMOUS JURY
FOR DEATH SENTENCES
The following reflects where we were at the end of the 2005 legislative session. Please check back for updates on these issues, which should be complete by January 13, 2006. Thank you for your patience. As far as we are aware, there is no such bill under consideration in the 2005 session. And yet, it would make sense to pass such bill, if only as a matter of fiscal responsibility. Studies have shown that the less unanimous a jury is in deciding to sentence a convicted murderer to death, the more likely it is that the death sentence will eventually be overturned. And when that happens, we all have to pay for the state to go back and re-sentence the prisoner – a huge waste of tax dollars, and further burden on the families of the victims. FADP advocates for the elimination of all death sentences, but if we are going to kill prisoners, we must use the utmost of caution. Requiring a unanimous jury for death sentencing would be an important step towards cost savings and a more just legal system.
